We are applied to looking at Apple involved in a number of authorized disputes relating to its products and companies, but this just one is a little bit distinctive. The Cupertino-based mostly corporation has submitted a lawsuit in opposition to Ukrainian indie film director Vasyl Moskalenko, who wrote the comedy movie titled Apple-Person.

The first factor you might presume is that the movie has anything about Apple (the firm), but it does not. Alternatively, the film is a satire on well known superheroes as the main character has the superpower to levitate apples (sure, the fruit). The movie was crowdfunded by Kickstarter, which raised about $120,000.

However, Apple’s authorized department seems to have been fewer than happy to have the company’s title affiliated with a comedy movie. Although the Apple-Man director reported his motion picture has by now been accepted by the United States Patent and Trademark Business office (PTO), Apple is in search of to have the trademark registration application denied by mounting “an intense opposition.”

Apple has initiated demo proceedings against Moskalenko about fears that buyers are possible to imagine that Apple-Guy is “associated with, or authorised, endorsed, or furnished by Apple,” the corporation claimed in a 467-site court filing.

Moskalenko argues that the lawsuit from Apple is “trademark bullying” due to the fact the movie would make no point out of Apple solutions. The director fears that he will have to devote all the crowdfunded income on litigation or even be pressured to “delete” the movie.

My film is about apples, the fruits. […] I’ll have to spend virtually all my Kickstarter funds on litigation. […] If my registration would be denied, there are no ensures that Apple wouldn`t need to delete my film just after its release.
